Selling a House As-Is in PA: What You Still Have to Disclose

Selling a House As-Is in PA: What You Still Have to Disclose

Lots of people want to sell as-is. No repairs. No fixing what the inspector finds. That’s fine. You can do it.

But “as-is” doesn’t mean you stop telling the truth about the house.

What “as-is” actually means

It means you’re not agreeing to make repairs. The buyer can still inspect. They can still walk away during the inspection period if their agreement gives them that right. You just won’t be fixing things.

The disclosure part

Pennsylvania’s Real Estate Seller Disclosure Law requires most home sellers to fill out a property disclosure statement and disclose known material defects (68 Pa.C.S. Chapter 73). Selling as-is doesn’t change that.

There are exemptions. One example: transfers by a fiduciary administering an estate (68 Pa.C.S. §7302). Even then, if you actually know about a material defect, PA REALTORS® points out you still have to disclose it.

My rule: if you know about it, disclose it. A leaky basement you hid is how a sale turns into a lawsuit.

When as-is makes sense

  • The house needs more work than you want to pay for.

  • You’re out of state, or you’re handling an estate.

  • You’re short on time.

  • The likely buyers are investors or flippers anyway.

When fixing a few things pays off

Sometimes small stuff (paint, a handrail, a dead outlet, a clean-out) makes a house show a lot better for little money. I’ll walk the house and tell you straight which fixes are worth it and which aren’t.

Your two as-is routes

  1. List it as-is on the open market. You reach every buyer, including investors.

  2. Sell it directly to me. No showings, no repairs, and a closing date you choose.

I can show you both. I also make direct offers. When I buy, I’m buying for myself, not acting as your agent, and I put that in writing before you sign anything.

We see a lot of as-is sales in older housing stock: Harrisburg’s Allison Hill, York city, Steelton and Lebanon. The disclosure rules are the same in every one of those places.

FAQ

Can you sell a house as-is in Pennsylvania?

Yes. You can list or sell a house without agreeing to repairs. Buyers can still inspect, and you still have to disclose known material defects.

Do I have to fill out a seller disclosure if I sell as-is in PA?

Usually, yes. Pennsylvania’s Seller Disclosure Law still applies to most residential sales. There are exemptions, like certain estate sales, but known material defects should still be disclosed.

Is it better to sell as-is or fix up first?

It depends on the house. Small, cheap fixes can pay off. Big repairs often don’t. Get a walk-through and a side-by-side net number for both options.
